Terms of Use

These Terms of Use ("Terms") govern your access to and use of the QuizAI service, including the Teacher mobile app, the Student mobile app, the Teacher web app, the Student web app, and the Admin web panel (each a "Service", and together the "Services"). The Services are provided by ACCESS Software Solutions ("ACCESS", "we", "us", or "our"), a sole proprietorship registered with the Philippine Department of Trade and Industry under Business Name Registration No. 3377044, with principal place of business at San Luis, Baguio City 2600, Philippines. Questions or notices may be directed to info@accessph.net.
By installing, accessing, or using any of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Definitions
- "Account" — the credentials provisioned for you within the ACCESS School Management System and used to sign in to a Service.
- "Institution" — the school, college, or organization that authorizes you to use the Services (typically your employer or the school you attend).
- "Teacher User" — an authenticated user assigned the teacher role.
- "Student User" — an authenticated user assigned the student role.
- "Content" — any material you create, upload, submit, or transmit through a Service, including quizzes, questions, answer sheets, scans, rosters, and student responses.
2. Eligibility & Account Registration
2.1 Account Source
All Accounts for the Services are provisioned through the ACCESS School Management System. You may not use the Services without a valid ACCESS Account authorized by your Institution. Account creation, password resets, role assignment (teacher/student), and identity verification are governed by the ACCESS School Management System's own terms and policies.
2.2 Minimum Age
- Teacher Users must be at least 18 years of age and legally authorized by an Institution.
- Student Users must be at least 13 years of age. Student Users under the age of majority in their jurisdiction use the Services under the consent and supervision of their Institution and, where applicable, a parent or legal guardian.
2.3 Accurate Information
You agree to keep your Account information current and accurate. You are solely responsible for all activity that occurs under your Account and for safeguarding your credentials and device. Notify us at info@accessph.net immediately of any unauthorized access.
3. The Services
The Services consist of five distinct components. Sections 3.1 – 3.5 below describe the scope, permitted uses, and service-specific rules for each.
3.1 Teacher Mobile App
Package: net.accessph.quizaiteacher (Android).
Permitted use. The Teacher Mobile App enables authenticated Teacher Users to:
- view and manage classes and student rosters synced from the ACCESS School Management System, and author additional manual classes;
- create, edit, publish, and close quizzes, questionnaires, and questions;
- create AutoQuizzes — quizzes generated from an answer key, either by scanning a master answer sheet or by building the key on an on-screen bubble matrix — and manage their answer keys (set or change correct options, re-arrange, add, or delete items) until the first answer sheet is processed, after which the quiz definition is locked so recorded scores stay reproducible;
- capture answer-sheet images through the device camera and submit them for optical-mark-recognition (OMR) processing, including scans bound to a specific quiz;
- view quiz results, scores, and per-student analytics;
- receive in-app service notifications (e.g. processing results) fetched on an adjustable interval;
- toggle light/dark/system theme and enable biometric login.
Device permissions. The app requests camera access (for scanning) and biometric authentication (for session unlock). You may revoke these permissions at any time through the operating system; features requiring the permission will be disabled accordingly.
Offline behavior. Certain screens cache data on the device for offline access. Cached data is cleared on logout or when the Account's API key expires.
3.2 Teacher Web App

Permitted use. The Teacher Web App provides the full set of teacher features, including (without limitation) classroom administration, questionnaire generation and PDF export, AutoQuiz creation from scanned master answer sheets, live proctoring of synchronous quiz sessions, OMR scan review and correction (including enrolling an unrecognized student and aligning their scan in one step), analytics, and subscription management (see Section 5).
Browser sessions. Sessions are time-limited. Closing the browser or remaining idle beyond the session timeout will require re-authentication.
3.3 Student Web App

Permitted use. The Student Web App allows authenticated Student Users to:
- view quizzes published to their enrolled classes;
- take quizzes within the parameters set by their Teacher User, including timed synchronous sessions;
- join a live quiz by entering the reference code printed on the questionnaire (the same code distributed by the Teacher User);
- view their own results after a quiz has been released by the Teacher User.
Academic-integrity controls. The Student Web App may record session-integrity events (e.g. focus loss, attempted tab switches, window blur) and report them to the Teacher User. By using the Student Web App you acknowledge and consent to this monitoring solely for the purpose of preserving assessment integrity.
3.4 Student Mobile App
Package: net.accessph.quizaistudent (Android).
Permitted use. The Student Mobile App enables authenticated Student Users to take and join quizzes from a personal device:
- log in with their school-issued ID and the questionnaire reference code, or with Google Sign-In;
- scan a QR code printed on the questionnaire (or shown on the teacher's live screen) using the device's native camera, which routes the student into the live quiz via Universal Links / App Links when the app is installed and the user is authenticated;
- take quizzes — both asynchronous and live (synchronous) — including cross-device sessions where the student may continue on the web without losing progress;
- view their own results subject to the Teacher User's release-results policy.
Single-answer rule. When a Student User joins the same live quiz from both the mobile and the web app, the first submission for any given question is final. Subsequent submissions from the other device are rejected as locked. By using the Student Mobile App you acknowledge and consent to this rule.
Device permissions. The app requests camera access (only when you choose to scan a QR code) and biometric authentication (optional session unlock). You may revoke either at any time through the operating system; features requiring the permission will be disabled accordingly.
3.5 Admin Web Panel

Permitted use. The Admin Web Panel is restricted to authorized administrators of the operating Institution and of ACCESS. It permits:
- creating, editing, deactivating, and deleting user accounts;
- assigning or revoking the
teacher,student, oradminrole; - resetting passwords and viewing audit logs of administrative actions.
Administrators agree to access the panel only for legitimate operational and compliance purposes, to use the principle of least privilege when assigning roles, and to keep credentials confidential. Misuse of the Admin Web Panel — including reviewing user data without a documented operational reason — is a material breach of these Terms.
4. Acceptable Use
You agree that you will not:
- use the Services to cheat, assist others in cheating, or subvert assessment integrity;
- impersonate another user, including submitting a quiz on behalf of another student;
- upload malicious code, or attempt to probe, scan, or compromise the Services or their underlying infrastructure;
- reverse-engineer, decompile, or disassemble any portion of the Services, except to the extent that applicable law expressly permits;
- use automated means (bots, scrapers, scripts) to access the Services, except through documented public APIs with valid credentials;
- upload Content that infringes intellectual-property rights, violates privacy rights, or is unlawful, defamatory, obscene, or harassing;
- share, lease, or sublicense your Account credentials or API keys to any third party;
- use the Services in violation of any applicable law, including the Philippine Data Privacy Act of 2012 (R.A. 10173), the Cybercrime Prevention Act (R.A. 10175), or any school or institutional policy.
We may, at our sole discretion, suspend or terminate Accounts that violate this Section, and may report unlawful conduct to the appropriate authorities or Institution.
5. Subscriptions & Payments (Teacher Tiers)
5.1 Free vs. Paid
- The Student Web App is free to Student Users whose Institution is enrolled in QuizAI.
- The Teacher Mobile App and Teacher Web App offer a free base tier and optional paid subscription tiers unlocking additional features, higher usage limits, or advanced analytics.
5.2 Billing
Subscriptions are billed in advance on a recurring basis (monthly or annually, as you select). By subscribing you authorize us (or our authorized payment processor) to charge the payment method on file for the then-current fees until you cancel.
5.3 Cancellation & Refunds
You may cancel a subscription at any time through the in-app settings or by emailing info@accessph.net. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. Except where required by applicable law, fees already paid are non-refundable.
5.4 Price Changes
We may change subscription prices on prospective renewal terms with at least thirty (30) days' prior notice to the email associated with your Account. Continued use after the change takes effect constitutes acceptance.
5.5 Taxes
All fees are stated exclusive of taxes. You are responsible for any applicable VAT, sales, or use tax.
6. Content & Intellectual Property
6.1 Your Content
You retain ownership of all Content you create or upload. You grant ACCESS a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and process your Content solely to the extent necessary to operate, secure, and improve the Services, and to support the Institution that provisions your Account.
6.2 Teacher-Created Quizzes
Teacher Users retain ownership of quizzes, questions, and questionnaires they author. Sharing such material with Student Users through the Services does not transfer ownership.
6.3 Student Responses
Student response data is owned by the Student User and the Institution. Teacher Users may view, export, and grade responses strictly for legitimate academic purposes.
6.4 ACCESS IP
The Services, including all software, branding, text, graphics, UI designs, and compilation of Content on our own pages, are owned by ACCESS or our licensors and are protected by Philippine and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for their intended educational purposes.
6.5 Feedback
Any feedback, suggestions, or ideas you provide about the Services may be used by ACCESS without restriction or compensation.
7. Third-Party Services
7.1 ACCESS School Management System
Accounts, enrollments, class schedules, and rosters are sourced from the ACCESS School Management System, which is a separate product operated by ACCESS and governed by its own terms. Your use of the QuizAI Services presumes a valid, active Account in that system. If your Account is disabled in the ACCESS School Management System, your access to all QuizAI Services will be terminated concurrently.
7.2 Institutional Control
Your Institution may:
- provision, modify, or deprovision your Account;
- access teacher-authored Content and student response data belonging to its users;
- export, archive, or delete such data in accordance with its records policies.
ACCESS acts as a service provider to your Institution with respect to these operations.
8. Privacy
Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which covers all five Services together. Each mobile app additionally publishes a focused notice — see Teacher Mobile · Privacy Policy and Student Mobile · Privacy Policy. By using the Services you acknowledge that you have reviewed the Privacy Policy. The Services comply with the Philippine Data Privacy Act of 2012 (R.A. 10173) and its implementing rules and regulations.
9. Service Availability & Changes
9.1 No Guaranteed Uptime
We strive to keep the Services available, but we do not warrant uninterrupted or error-free operation. We may perform scheduled maintenance or unscheduled interventions that temporarily restrict access.
9.2 Modifications
We may add, modify, deprecate, or remove features at any time. Where a change materially reduces functionality of a paid tier, we will provide reasonable prior notice and, where required by law, a pro-rata refund for the unused portion of the current billing period.
9.3 Mobile App Updates
You agree to keep the Teacher Mobile App and the Student Mobile App updated to a supported version. We may refuse to serve API requests from unsupported client versions for security reasons.
10. Suspension & Termination
10.1 By You
You may stop using the Services at any time. Uninstalling the mobile app or logging out of the web apps does not, by itself, delete your Account; contact your Institution for Account deletion.
10.2 By Us
We may suspend or terminate your access to any Service, with or without notice, if:
- you violate these Terms;
- your Institution deprovisions your Account;
- you fail to pay subscription fees when due;
- we are required to do so by law or by a valid order from a competent authority.
10.3 Effect of Termination
Upon termination, your right to access the affected Service ceases immediately. Sections that by their nature should survive termination (including Sections 4, 6, 8, 11, 12, 13, and 14) will continue in effect.
10.4 Account Deletion Mechanics
The Services apply role-specific deletion policies so that the Institution's grade records and the integrity of past assessments are preserved while you exercise your right to be forgotten. The full mechanics are documented in the Privacy Policy; the operative summary follows.
10.4.1 Teacher Account Deletion — Content Reassignment to AINGEL
When a Teacher User's Account is deleted (by the User, by the
Institution administrator, or by us under Sections 10.1 / 10.2), the
content the Teacher User authored — quizzes, questionnaires, OMR scan
records, and the student responses keyed to those quizzes — is
re-attributed to a system-defined universal teacher account
identified within the Services as AINGEL. AINGEL is not a
natural person; it is an internal placeholder owned and operated by
ACCESS that holds inherited content so the Institution can continue
to access historical grade records and run item analyses on quizzes
whose original author has left.
The Teacher User's own user record, their personal class schedules, and any device-bound API keys are deleted. Subscription entitlements, device sessions, and quotas attached to the Teacher User cease.
By using the Teacher Mobile App or Teacher Web App you acknowledge and consent to this reassignment as a condition of preserving the Institution's right to retain assessment records.
10.4.2 Student Account Deletion — Anonymizing Soft Delete
When a Student User's Account is deleted, we apply an anonymizing soft delete: the User's row in our user table is retained so that the questions they answered keep their internal references, but every identifying field (name, email, password hash, Google identifier) is replaced with non-reversible random values, the account is deactivated, and the deletion timestamp is recorded. The Student User is removed from every class roster and from any other listing or attribution surface in the Services.
The Student User's submitted answers (and the wrapping quiz sessions) are retained because they contribute to the Institution's grade records and to aggregate item-analysis statistics; without them, deleting one Student would retroactively damage the integrity of every co-attempted quiz. Because the user record is anonymized, the answers can no longer be traced back to the individual Student outside of records the Institution itself maintains.
By using the Student Mobile App or Student Web App you acknowledge and consent to this soft-delete approach as a condition of preserving the Institution's right to retain assessment records and the Service's right to maintain analytics integrity.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESS DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND FREEDOM FROM ERRORS OR HARMFUL COMPONENTS.
We do not warrant that OMR scan results, auto-grading, or any automated processing will be free from error. This includes quizzes generated automatically from an answer key (AutoQuiz): the Teacher User is responsible for verifying the parsed or hand-built key before scoring student answer sheets against it. Teacher Users remain responsible for reviewing and, where necessary, correcting automated results before they are released to Student Users or recorded in official records.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE AFFECTED SERVICE DURING THAT PERIOD, OR (B) PHP 1,000.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, the foregoing exclusions and limitations apply to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless ACCESS and its officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your violation of these Terms;
- your misuse of the Services;
- your Content, including any claim that it infringes third-party rights or violates law;
- your violation of any applicable law or regulation.
14. Governing Law & Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict-of-laws principles.
14.2 Venue
Any action or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the competent courts of Baguio City, Philippines, and you irrevocably consent to the personal jurisdiction of such courts.
14.3 Informal Resolution
Before filing any formal action, you agree to contact us at info@accessph.net and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes we will update the "Last Updated" date above and, where appropriate, notify you through the Services or by email. Your continued use of the Services after the updated Terms take effect constitutes acceptance.
16. General Provisions
- Entire Agreement. These Terms, together with the Privacy Policy and any order forms or subscription confirmations, constitute the entire agreement between you and ACCESS regarding the Services.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in full force.
- No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force Majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, acts of government, internet outages, or labor disputes.
- Notices. Notices to ACCESS must be sent in writing to the address or email above. Notices to you will be sent to the email on your Account or posted within the Services.
- Language. These Terms are executed in English. In the event of a conflict with any translation, the English version controls.
